Shout Hearts — Terms of Service

1. Eligibility & Adult Account Responsibility

• Parental Management Required: The Service is intended for use by children under adult supervision. Accounts must be registered, managed, and paid for exclusively by a parent or legal guardian over the age of 18.
• Consent Definition:By creating an account and allowing your child to use the web application, you warrant that you are the legal guardian and expressly consent to the data practices outlined in our Children's Privacy Policy.
• Account Security: Parents are responsible for maintaining the confidentiality of their login credentials and all activities occurring under their account dashboard.

2. Subscriptions, Billing, and Cancellations via Stripe

• Subscription Model: Access to the web application features requires an active, paid subscription billed directly through our site.
• Payment Processing:All payments are securely processed by Stripe. By subscribing, you agree to Stripe's terms and authorize recurring charges.
• Auto-Renewal & Cancellation: Subscriptions automatically renew at the end of each billing cycle. You may cancel your subscription at any time directly through your account settings page on Shouthearts.com.
• Refunds: All financial transactions and refund requests are handled directly by Shout Hearts via support@shouthearts.com.

3. Intellectual Property & License

• Limited License: Shout Hearts grants you a limited, non-exclusive, non-transferable, and revocable license to access our web tools for personal, non-commercial purposes.
• Ownership: All web content, interactive designs, illustrations, character graphics, software code, and educational curricula are the exclusive intellectual property of Shout Hearts.
• Restrictions: You may not copy, reverse-engineer, scrape, modify, distribute, or use any part of our website or branding for commercial purposes without explicit written consent.

4. School Referral Program Disclaimers

• Independent Relationship: Shout Hearts operates independently of any school or educational institution. If you were referred to our platform by a school, the school acts solely as a referring party.
• No Educational Records: Use of this website does not constitute or create an official student record under FERPA. Your financial contract and data authorization remain strictly between you and Shout Hearts.

5. Limitation of Liability & Educational Disclaimers

• Not Medical Advice: Shout Hearts is an emotional education tool designed to support general emotional development. It does not provide medical, psychological, or clinical mental health therapy. It is not a substitute for professional medical advice, diagnosis, or crisis treatment.
• "As-Is" Service:To the maximum extent permitted by law, the Service is provided "as-is" without warranties of any kind. Shout Hearts is not liable for any web downtimes, server interruptions, or data connection bugs.

6. Termination & Data Deletion

• Account Deletion: Parents may terminate their account at any time. Upon complete account deletion requests submitted to support@shouthearts.com, all linked child data, nicknames, and mood logs will be completely purged from our Supabase database.
• Breach: We reserve the right to suspend or terminate account access immediately if these Terms are violated.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
